Equipment Hire

This agreement shall be between the Customer (hereinafter referred to as ‘the Hirer’), and Baby Service Bali (hereinafter referred to as ‘BSB’).

All equipment supplied to the Hirer shall remain the property of BSB.

1 Payment

After receiving your enquiry, we will contact you within one business day to inform you about the availability of your order. BSB hiring services work on a first come first serve basis. Payment can be settled via bank transfer to our Indonesian bank account or cash on delivery/ after check in. The Hirer shall be responsible for all expenses including any delivery fees invoiced by BSB. BSB shall send a confirmation email to the Hirer.

2 Prices, Delivery & Pick-Up Services

Minimum hire of baby equipment: 3 days. Minimum hire of pool fences: 4 days.

Prices are subject to change without notice; however, the price listed at the time when your order is submitted shall be applicable. All prices on this website are quoted in Indonesian Rupiah (IDR) and include any applicable taxes. The currency converter shall be used for comparative purposes only.

BSB shall deliver the equipment to the address the Hirer has specified in the order. The Hirer shall notify BSB of any delivery address changes at least 48 hours in advance. Pick-up and delivery services shall be agreed on at a mutually convenient time upon the commencement and the expiration of the hire period.

It is essential to advise the respective host, hotel, or private residence that BSB will contact them about the drop-off and pick-up times of their equipment. They shall receive a call within 24 hours of the drop-off date. They shall then receive another call regarding the pick-up time of their equipment, again 24 hours in advance.

Deliveries and pick-ups for the Kerobokan & Canggu area shall incur an additional fee of IDR 100.000.

Deliveries and pick-ups for the Kuta, Legian, Seminyak, Tanah Lot, Sanur, Jimbaran & Nusa Dua area as well as the airport shall incur an additional fee of IDR 150.000.

Deliveries and pick-ups for the Uluwatu & Ubud area shall incur an additional fee of IDR 250.000.

Every pool fence order shall incur an additional fee of IDR 500.000 for delivery, set up and pick up. For Uluwatu & Ubud area the additional fee starts from IDR 600.000 depending on exact location of the villa/ hotel.

BSB shall reserve the right not to deliver orders to the Bangli, Klungkung, Karangasem and Singaraja area. Alternative arrangements available upon request.

3 Damages & Sanitary Conditions

The hired equipment must be returned in the same condition as it was handed out to the Hirer (considering fair wear and tear). If the equipment is returned un-cleaned or stained, BSB shall be entitled to charge an additional amount of IDR 70.000 per item. Items must be returned with all accessories and parts intact and in proper working order. The Hirer shall reimburse BSB for all equipment that is lost, stolen, or returned damaged or incomplete while hired out, at the current replacement cost of the equipment.

4 Liability

The Hirer hereby agrees to disclaim, waive, and release BSB, its heirs, executors, administrators, agents, assignees, and all other affiliated persons, firms, or corporations from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, and particularly on account of any and all injuries, known and unknown, to persons or properties or both, resulting in any way from the use of baby equipment that was hired from BSB by the Hirer.

Without limiting the generality of the foregoing, BSB shall not be held liable for any injury to the Hirer, the Hirer’s children, or any other adults or children, or any damage to property by the use of the equipment. The Hirer hires the equipment at the Hirer’s own risk!

The Hirer also acknowledges that the Hirer is familiar with and knows how to operate the equipment and is taking full responsibility for using the equipment.

The Hirer represents and warrants that each item of hired-out property is of a type, design, quality, and manufacture that is selected by the Hirer, acceptable to the Hirer, and suitable for the Hirer’s purposes. The Hirer acknowledges that BSB is not the manufacturer or supplier of the equipment or the representative of either, that BSB is not required to enforce any manufacturer’s warranties on behalf of BSB or the Hirer, and that BSB hires out the equipment to the Hirer “as is”, without warranty or representation, either explicit or implied, and BSB explicitly disclaims any warranty, either explicit or implied.

The Hirer further agrees to indemnify and hold BSB harmless from and against any and all claims, liabilities, including negligence, tort and strict liabilities, demands, actions, suits and proceedings, losses, costs, penalties, and damages, including without limitations, reasonable attorneys’ fees and costs (collective, “claims”), arising out of, connected with, or resulting from the manufacture, selection, hire, purchase, delivery, possession, condition, use, operation, handling, transportation, or return of the equipment.

5 Cancellation

Up to 7 days before the commencement of the actual hire period, the Hirer may cancel the order at any time, with no cancellation fee involved, and the Hirer shall receive a full 100% refund. For cancellations less than 7 days before the commencement of the actual hire period, BSB shall reserve the right to charge a 50% cancellation fee. Orders cancelled within 2 days of the drop-off date or after delivery will be charged in full.

If the Hirer is unable to fly due to cancellations of flights because of any unexpected or catastrophic events, including natural disasters, the Hirer can move the booking without any extra costs up to a period of 6-months, starting from the first date of the original reservation. If the Hirer decides to cancel the booking completely, BSB shall charge a 50% cancellation fee.

Cancellations must be submitted in writing to BSB via info@babyservicebali.com, which shall be confirmed by BSB in return.

The Hirer hereby declares that the terms and conditions have been completely read and are fully understood and voluntarily accepted. The Hirer acknowledges that the purpose of this agreement and the disclaimer is to induce BSB to hire out the equipment to the Hirer. The Hirer acknowledges that the Hirer is precluded forever from any claims against BSB that may arise out of any equipment hire.
